Are tenants able to not pay rent due to COVID-19 circumstances?

Tenants who are not able to pay any part of their rent due to impacts of COVID-19 are required to notify their landlord via writing or declaration form of their inability to pay due to COVID-19. AB 832 is set to expire on September 30, 2021; tenants will then be required to resume their regular rent payment schedule and will have one year to repay any back due rent due accrued from March 2020. When does the moratorium on evictions end?

The current moratorium on evictions based on nonpayment of rent due to COVID-19, now under AB 832, is set to expire on September 30, 2021.

Is there assistance for renters with back-rent due from the City of Glendale?

What is the minimum a renter is expected to pay in rent each month?

Under AB 832, tenants are required to either pay 25% of their rent every month, or by September 30, 2021, pay 25% of rent owed for the period between September 1, 2020 and September 30, 2021.

If a renter has received funds for rent relief, can the renter re-apply for more funding?

If a resident had applied for funding through the State's Rent Relief program and received 80% of their rent previously, there is no need to re-apply. Applicants will receive previously issued rental assistance payments to 100% without resubmittal of an application.

EVICTION MORATORIUM

Eviction Moratorium

On Tuesday, October 20, 2020, the Glendale City Council adopted a revised Emergency Eviction Moratorium Order aligning the repayment schedule for past due rent with Assembly Bill No. 3088 (“AB 3088”). Under Assembly Bill No. 3088, Glendale’s residential eviction moratorium was modified to have expired on August 31, 2020.

UPDATE:

On January 29, 2021, California Senate Bill 91 became law, effective immediately. Senate Bill 91 extends through June 30, 2021, existing tenant protections under Assembly Bill 3088, which were set to expire on January 31, and provides additional protections for tenants experiencing COVID-19-related financial distress. Senate Bill 91 also establishes the State Rental Assistance Program, which permits the State and local governments to provide rental assistance on behalf of eligible tenants, using federally-appropriated funds.

On June 28, 2021, Governor Gavin Newsom (AB832) signed legislation to extend the state’s eviction moratorium through September 30, 2021 and clear rent debt for low-income Californians that have suffered economic hardship due to the pandemic. This extends tenant, landlord, and homeowner protections provided by SB 91 until September 30, 2021, including the current requirement that tenants pay 25% per month by September 30, 2021, when the moratorium ends.

Residential Evictions:

Here is what you need to know:

If you were unable to pay all or some of your rent between March 1, 2020 and August 31, 2020

If your landlord gives you a notice to "pay or quit," they must provide a notification which explains your rights and obligations. (A notice to "pay or quit" is a notice from your landlord that gives you a certain amount of time to pay the outstanding rent you owe or vacate your home.)
You cannot be evicted IF you return a declaration of COVID-19 related financial distress, signed under penalty of perjury, and returned within 15 business days of receiving a notice to "pay or quit."
Your landlord must provide this declaration to you to complete and sign, and it must be in the language of your rental agreement. It is very important that you provide the signed declaration within 15 business days or an eviction proceeding may be filed against you.
If your household income is more than 130% of the median household income in your county and more than $100,000, your landlord may demand proof of your COVID-19 related hardship be provided to support your declaration. There are several things you can use to satisfy this requirement, such as a tax return, pay stubs, and a statement from your employer, among other things.
If you are unable to provide the declaration to your landlord within 15 business days, you may still submit the declaration to the court for similar protections if you have a "good reason" for not providing it. "Good reasons" include mistakes, inadvertence, surprise, or excusable neglect as interpreted in the California Code of Civil Procedure.
If the Council adopts the revised Emergency Order revising the repayment schedule for past due rent to align with AB 3088, repayment of unpaid rent from March 1, 2020 through August 31, will commence on March 1, 2021 and required to be paid in 12 equal monthly installments.

If you were unable to pay all or some of your rent between September 1, 2020 and June 30, 2021

All of the same rights and obligations above apply.
In addition, by June 30, 2021, you must pay at least 25% of the rent due during the period of September 1, 2020 through June 30, 2021.
- You may do this by paying at least 25% each month, or by paying a lump sum equaling 25% of your rent during the time period, or by some other means.
- The key thing to remember is that - by June 30, 2021 - you must pay 25% of the rent due between September 1, 2020 through June 30, 2021.

Other Things You Need to Know

A landlord can only evict a tenant if they provide a legally valid reason.
Landlords who do such things as lock tenants out, remove personal property or shut off utility services to evict a tenant, rather than going through the required court process, could faces fines of between $1,000 and $2,500. These penalties are in effect until June 30, 2021.

RENT FREEZE (EXPIRED)

Rent Increase Prohibition/Rent Freeze: (Residential Tenancies Only) - EXPIRED

Rents are frozen effective March 24, 2020 regardless of when a rent increase notice was previously served.
Landlords may not issue new rent increases until the expiration of the emergency order, even if the increase is effective after the expiration of the order.
Any rent increase issued between March 25, 2020 and the expiration of the emergency order will need to be reissued once the order has expired.
The rent freeze applies to all residential rentals in the City of Glendale, except apartments built after February 1, 1995, individual condominium units, and single family dwelling. It also applies to accessory dwelling units and hotel rooms being rented as extended stays.
The rent freeze prohibition is in effect until October 31, 2020

COMMERCIAL EVICTION MORATORIUM (TO EXPIRE SEPTEMBER 30, 2021)

In effect until September 30, 2021
The commercial tenant shall notify the landlord in writing before the rent is due, or within a reasonable period of time afterwards not to exceed seven days, of the tenant’s inability to pay rent due to a COVID-related reason.
Tenants must retain documentation to demonstrate the reason for their inability to pay rent and its relation to the COVID-19 pandemic and present it no later than the time first payment of back-rent is due.
Tenants will have up to six months commencing upon the expiration of the moratorium on September 30, 2021 to repay any back due rent that was deferred because of the COVID-19 circumstances.
The moratorium does not apply to any commercial tenant with 100 or more employees, 11 or more locations or offices worldwide, or to any tenant that is a publicly traded company.

BEST PRACTICES FOR TENANTS AND LANDLORDS

For Tenants:

Communicate with your landlord about your inability to pay if your income is affected by the COVID-19 emergency.
Do not ignore any notices issued by the landlord or property manager.
All tenants are still responsible for any lawfully charged rents due.

For Landlords & Property Managers:

Work with tenants, during the eviction moratorium period.
Communicate with the tenant about their ability to pay.
Do not ignore the eviction moratorium in place.

EMERGENCY RENTAL ASSISTANCE PROGRAM

Available for households with incomes at or below 80 percent of Area Median Income, with a priority on helping households at or below 50 percent of Area Median Income as well as households unemployed for the preceding 90 days at the time of application.
Prioritizes the payment of rental arrearages.
Landlords can choose to accept 80 percent of any unpaid rent owed from April 1, 2020, through March 31, 2021. If a landlord accepts this funding, the landlord agrees to forgive the remaining unpaid rent for that covered period.
If a landlord chooses not to participate, the tenant can still apply for relief valued at 25 percent of unpaid back rent they owe for the covered period.
Qualified tenants will also be able to access funds to cover 25 percent of prospective rent for the months of April, May, and June of 2021, subject to funding availability.
Utility arrearages will also be eligible to be paid, subject to funding availability.
The State will directly administer $1.5 billion through either the State Rental Assistance program or through block grants to qualifying local jurisdictions.
Emphasis on multilingual, local outreach, fraud prevention, and customer service.
Program will be stood up to begin accepting applications in March 2021.

PROTECT TENANTS IMPACTED BY COVID-19

Limiting public disclosure of eviction cases involving nonpayment of rent between March 4, 2020 and June 30, 2021.
Protects low-income tenants from landlords assigning or selling their rental debt to a third-party debt collector.
“Pay or Quit” Notice period for nonpayment of rent extended from 3 to 15 days.
Protects tenants from being evicted for “just cause” if landlord is shown to be really evicting the tenant for COVID-19 related nonpayment of rent.
Landlord may not charge late fees for nonpayment of rent between March 1, 2020 and June 30, 2021 to tenants who have attested they are experiencing a COVID-19-related hardship.
Require landlords to notify all tenants who owe back rent about the availability of their rights and the rental assistance program via an informational notice by February 28, 2021.
